Our services are available to individuals who are 18 years of age or older and capable of entering into a binding legal agreement. By using our site or placing an order, you confirm that you meet this requirement.

Our wholesale and distribution services are available to registered businesses only. By applying for a wholesale account, you represent that you are an authorized representative of a legitimate business entity.

When you create an account with Braxx, you agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activity that occurs under your account

Braxx reserves the right to suspend or terminate accounts that contain inaccurate information or that have been used in violation of these Terms.

All prices listed on our website are in US dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time. If an error is discovered after your order is placed, we will contact you to confirm whether you'd like to proceed at the correct price or cancel the order.

Title and risk of loss transfer to you once we deliver your order to the shipping carrier. Products remain our property until payment is received in full.

Modifications to products: Braxx reserves the right to update or change component specifications on any product without prior notice. Such changes do not constitute grounds for returning a product.

Promotional codes and discounts must be applied at the time of purchase and cannot be applied retroactively. Promo codes generally cannot be combined with other offers unless stated otherwise.

Promotional discounts are available to retail customers only and may not be used by resellers, wholesalers, or distributors. Expired or discontinued promotions are not honored even if they remain visible on the site.

Wholesale pricing is available exclusively to verified dealers and retailers approved by Braxx. Wholesale accounts are subject to a separate wholesale agreement which outlines pricing tiers, minimum order quantities, and payment terms.

Wholesale customers agree not to resell Braxx products below the minimum advertised price (MAP) policy, where applicable. Violation of MAP policy may result in suspension or termination of your wholesale account.

Braxx reserves the right to approve or deny any wholesale application at its sole discretion.

Because we process orders quickly, cancellation requests must be submitted as soon as possible after placing your order. To request a cancellation, contact us directly at support@braxxus.com or call (949) 613-0367 with your order number.

Once an order has been shipped, it cannot be cancelled. In that case, please refer to our Return Policy below.

Orders are processed within 1–3 business days. Standard shipping typically takes 7–14 business days after processing. Expedited shipping options may be available depending on your location.

A shipping confirmation email with tracking information will be sent to the email address on your order once your shipment has been dispatched. If you don't see it, please check your spam or junk folder.

Braxx ships to addresses within the 48 continental United States. International shipping is available — please contact us prior to placing an international order for accurate shipping costs and timelines.

If your order arrives damaged, take photos of the damage (including packaging) and contact us within 7 days of delivery. We will work with you to resolve the issue as quickly as possible.

Braxx is not responsible for orders that are lost or stolen after confirmed delivery to the shipping address on file. If you have not received your order within 30 days of the expected delivery date, please contact us immediately so we can investigate.

If you refuse delivery of an order that you requested, Braxx reserves the right to deduct a flat return shipping fee from your refund to cover freight costs. The refund will be processed once the item is received and inspected at our facility.

To avoid delays in receiving your refund, please notify us at support@braxxus.com any time you refuse a shipment.

New and unused items: May be returned within 30 days of delivery for a full refund, minus return shipping costs. Items must be in original, unridden condition in their original packaging.

Used items: Items returned in used condition may be subject to a restocking fee of up to 25% of the purchase price, depending on the condition of the item.

Return shipping: Customers are responsible for return shipping costs unless the item arrived damaged or was shipped incorrectly by Braxx.

To begin a return, contact us at support@braxxus.com with your order number and reason for return. Do not ship items back without first receiving a return authorization from our team.

Once we receive and inspect your returned item, your refund will be processed within 5–7 business days to your original payment method. The time it takes to appear in your account may vary depending on your bank or payment provider.

All Braxx bikes come with a 12-month limited warranty covering manufacturing defects in materials and workmanship under normal use conditions.

The warranty does not cover:

• Damage from crashes, accidents, or misuse
• Unauthorized modifications or alterations
• Normal wear and tear (tires, brake pads, chain, grips)
• Damage from improper washing or water exposure
• Damage caused by using incompatible chargers or accessories

To submit a warranty claim, contact our support team at support@braxxus.com with the following:

1. Your full name and order number
2. A description of the issue
3. Clear photos or video showing the defect

We will review your claim and respond within 2 business days with next steps. Approved warranty claims may result in repair, replacement, or a partial refund at Braxx's discretion.

Our website is provided for lawful, personal, and commercial use in accordance with these Terms. You may not use the site to:

• Scrape, copy, or reproduce content without written permission
• Transmit harmful, fraudulent, or misleading content
• Attempt to gain unauthorized access to our systems
• Use automated tools to access or overload our website
• Collect personal information about other users
• Violate any applicable local, state, or federal laws

Braxx reserves the right to terminate access to our site for any user who violates these Terms.

All content on this website — including text, images, graphics, logos, product photos, and design — is the property of Braxx or its licensors and is protected by applicable copyright and intellectual property laws.

You may not reproduce, copy, distribute, or use any content from our website for commercial purposes without prior written permission from Braxx. Personal, non-commercial use with proper attribution may be permitted — contact us to request permission.

Braxx's total liability to you for any claim arising from these Terms shall not exceed the amount you paid to Braxx for the product or service in question.

You are solely responsible for complying with all applicable federal, state, and local laws governing the purchase, registration, and operation of electric motorcycles or bikes in your jurisdiction. Braxx does not provide legal advice regarding these requirements.

This includes, but is not limited to, requirements related to vehicle registration, rider licensing, insurance, and safety equipment such as helmets. We strongly recommend wearing a helmet and appropriate protective gear at all times while riding.

Riding electric motorcycles involves inherent risks. By purchasing and using a Braxx product, you acknowledge and voluntarily assume all risks associated with riding.

We encourage you to contact us first at support@braxxus.com to resolve any concern. Most issues can be resolved quickly and informally through direct communication with our team.

If a dispute cannot be resolved informally, both parties agree that it shall be submitted to binding arbitration administered by a recognized arbitration body under applicable commercial arbitration rules. Arbitration will take place in Orange County, California.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action related to these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Orange County, California.

Any claim arising from your use of our services must be filed within one (1) year of the date the claim arose, or it will be permanently barred.

Under California Civil Code Section 1789.3, California residents are entitled to the following consumer rights information:

If you believe that content on our website infringes your copyright, please send a written notice to support@braxxus.com that includes:

• Your name, address, phone number, and email
• A description of the copyrighted work you believe has been infringed
• The specific URL or location of the infringing material on our site
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information you've provided is accurate and that you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

Braxx reserves the right to update or modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Your continued use of our website or services after any changes take effect constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Braxx's failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

Our website may contain links to third-party websites or reference third-party services such as payment processors, shipping carriers, or financing partners. Braxx is not responsible for the content, policies, or practices of any third-party service.

When you interact with a third party through our site — for example, completing a financing application or tracking a shipment — you are subject to that third party's terms and privacy policy. We encourage you to review those terms before providing any personal information.
